Pflugerville cases are Travis County cases

Pflugerville lies in Travis County, with a small sliver extending into Williamson County near Hutto. For almost every Pflugerville resident, a divorce is filed with the Travis County District Clerk and assigned to one of the family-court dockets at 1700 Guadalupe Street. Hutto residents file in Williamson County; Manor residents file in Travis County.

Travis County's family courts use a central docket system: your case is not permanently assigned to one judge, so the judge who hears temporary orders may not be the judge at trial. That changes strategy — arguments must be built on the record and the law, not on a single judge's preferences. Eric has worked within that system for more than two decades.

Travis County also has a Standing Order in every family case that takes effect at filing and restricts property transfers, insurance changes, and travel with the children.

Every situation is unique. Eric will evaluate yours in a confidential consultation.

Custody, support and the house

Pflugerville families are young, with children in Pflugerville ISD and homes bought in the last ten years that now carry real equity. The three issues that decide most cases are who keeps the house, how the children's week is divided, and how support is calculated when both parents work.

On child custody, Texas presumes joint managing conservatorship; the fight is over primary residence and the possession schedule. The Standard Possession Order is the default, but Travis County judges approve expanded and 50/50 schedules when both parents are capable and live close to the schools.

Child support follows the guideline percentages on the paying parent's net resources, up to the $11,700 monthly cap. For the house, the usual outcomes are a sale with the equity split, or one spouse buying out the other's share with a refinance within a set deadline. Property division also has to account for retirement accounts, which require a separate QDRO to divide without tax penalties.

Military and federal families

Pflugerville and northeast Austin are home to many active-duty, reserve, and retired service members and federal employees. A military divorce brings federal rules most attorneys never see: the Servicemembers Civil Relief Act, the 10/10 rule for direct retirement payments from DFAS, the one-year Survivor Benefit Plan election deadline, and custody provisions that survive a deployment.

Eric has handled military divorces for Central Texas families for years, for service members and for spouses, and drafts the retirement language DFAS will actually accept.

Frequently Asked Questions

Where is a Pflugerville divorce filed?

+

In Travis County, at the District Clerk's office in the Civil and Family Courts Facility, 1700 Guadalupe Street, Austin. The small part of Pflugerville in Williamson County, and all of Hutto, file in Georgetown.

What is the Travis County central docket?

+

Family cases in Travis County are not assigned to one judge for the life of the case. Different judges may hear temporary orders, discovery disputes, and trial. Eric builds cases that hold up regardless of who is on the bench.

Can we do a 50/50 custody schedule?

+

Yes, when both parents live near the children's school and can cooperate on logistics. Travis County judges regularly approve equal possession schedules by agreement and sometimes after a contested hearing.

I am active duty. Can my spouse divorce me while I am deployed?

+

The Servicemembers Civil Relief Act lets a deployed service member ask the court to pause the case. It does not stop the divorce permanently, but it protects you from a default judgment while you cannot participate. See the military divorce page.

+

It depends on whether the case is agreed or contested. Eric gives a realistic estimate at the consultation. See How much does a divorce cost in Texas.
